By submitting your event application, waiver, and/or registering for our events, you agree to the following terms.
ASSUMPTIONS OF THE RISKS OF BAY SWIMMING - Bay swimming is inherently dangerous. Bay swimmers have been injured and killed. For example, a fishing boat once killed a swimmer. Sea lions and other marine animals have attacked swimmers. Swimmers have been injured by objects in the water, both floating and fixed. There may be health hazards associated with pollution in the bay. Bay currents, often more powerful than the strongest swimmer, are unpredictable and have swept swimmers off course. Bay waters are cold. Temperatures typically range between 45 and 61 degrees Fahrenheit. Swift currents and cold water have precipitated drowning. heart attacks, and hypothermia. These are just some of the hazards and dangers of bay swimming.
I UNDERSTAND AND ASSUME ALL RISKS ASSOCIATED WITH SWIMMING IN THE BAY.
On behalf of my heirs, assignees, personal representatives, and next of kin, I hereby release and hold harmless Water World Swim Clinics Organizations, its officers, members, officials, agents, and employees and other participants, with respect to all injury, disability, death, loss, injury, or damage to me or my property, whether arising from the negligence of Water World Swim, LLC, its members, officers, or otherwise.
BY SIGNING THIS WAIVER AND RELEASE, I CERTIFY THAT I UNDERSTAND THAT I CANNOT SUE ANY PERSON, INSTRUCTOR, OR COACHES OR THOSE WHO ACT ON BEHALF OF THE OPEN WATER WORLD SWIM ORGANIZATION OR THOSE WHO MAY HAVE AUTHORITY OVER THE COMPANY, AND NO ONE ELSE CAN SUE ON MY BEHALF.
In consideration of the acceptance of my entry in any Water World Swim, LLC open water swim, I hereby: 1. agree to comply with all rules and regulations and event instructions of Water World Swim, LLC and its Directors; 2. attest and verify that I am physically fit and have sufficiently trained for open water swimming and that my physical condition is in optimal conditions; 3. consent to be stopped from swimming by any officer that may consider or which may be deemed advisable in the vent of injury, accident, or illness during any Water World Swim, LLC event; 4. agree that in the event of a race cancellation due to conditions beyond the control of Water World Swim, LLC, including but not limited to a storm, rain, inclement seas or weather, winds, “Acts of God”, “Acts of Terrorism”, or other conditions, my entry fee shall be non-refundable.
Under no circumstances may you sell, trade or allow someone else to take your entry. Such substitutions jeopardize our insurance and our ability to secure the permits necessary to produce future events.
If you cannot participate in an event for which you have registered or wish to attend a different event, you may be eligible to receive a partial Rollover Credit, which may be applied towards any future Water World Swim event. Rollover Credits are presented as coupon codes for use towards one event of equal or greater value are valid for twelve months after they have been offered to the participant.
To retain a Rollover Credit, you must notify us of your intention to pull out of a race no later than 8 days prior to the event date. Medical reasons or military deployments with supporting documentation submitted within the 8 days before race day are eligible for a credit but not a refund.
If within the 30 days leading up to the event a medical reason, military deployment or death in the family will prevent your participation, you must notify us in writing and attach documentation (i.e. doctor's note, deployment notice) to support your claim. In these three cases, you will be eligible for 100% refund. If in the event your medical issue/recovery resolves before race day but your training is deemed inadequate, we will issue a full 100% credit.
Rollover credits are not eligible for transfer. If you cannot attend the event on which you used your rollover credit, you will not be eligible for any rollover credits based on that event.
65% of the original entry fee paid will be retained by Water World Swim, LLC. Therefore, 35% of the original entry fee paid will be credited to you. This credit is valid until the end of the year in which the event takes place unless otherwise noted and can be used towards any applicable event for which the registration cost is of equal or greater value. Rollover credits, once used, cannot be used again.
If the entry fee is under $100 (regular Alcatraz Clinics, Swim With Pedro) or is for a Monthly Alcatraz, the credit is transferable to another session of the same event on a different date.
This applies to Galapagos, Greece, Costa Rica, Italy, and Cuba trips.
The 50% non-refundable deposit paid at registration is non-refundable with no exceptions. The remaining 50% is refundable until 48 hours prior to trip start. Beginning with the remaining 48 hours prior to the trip, 100% of registration is non-refundable.
